MARCH 26: Chief Minister Omar Abdullah today addressed key concerns raised in the Legislative Assembly regarding the creation and upgradation of courts, as well as the proposal for granting district status to Akhnoor. He clarified that the creation and upgradation of courts are not within his jurisdiction but are instead decided by the High Court.
In response to a question from Vijay Kumar, the Chief Minister explained that any recommendations for the creation or upgradation of courts are made by the High Court, and it is the government’s responsibility to implement these recommendations. Omar Abdullah emphasized that his administration works to ensure the effective implementation of decisions taken by the judiciary regarding court infrastructure.
Regarding the upgradation of the Munsiff’s Court (JMIC) in Hiranagar, the Chief Minister informed the House that no such recommendation had been received by the government to elevate it to an Additional District and Sessions Court or a Sub-Judge Court. He clarified that without any official recommendations from the High Court, the matter of upgradation could not be pursued further.
The Chief Minister’s statement comes as part of the ongoing efforts to address the demands for better judicial infrastructure and the need for more accessible courts across the region. While several areas in Jammu and Kashmir have expressed concerns over the lack of sufficient judicial facilities, the government’s role is primarily to implement the recommendations made by the High Court.
In a separate issue, Omar Abdullah also responded to a question raised by Mohan Lal Bhagat regarding the status of Akhnoor. The Chief Minister firmly stated that there is no proposal currently under consideration to grant separate District Status to Akhnoor. He clarified that although the demand for district status has been raised in the past, no official proposal has been submitted to the government for consideration.
These responses from the Chief Minister highlight the limitations of the state government in some areas, particularly those related to judicial and administrative changes. The Chief Minister’s remarks underline the separation of powers between the executive and judiciary, with the High Court playing a central role in decisions related to the creation and upgradation of courts.
As the session continued, the Chief Minister reassured the House that the government would continue to work closely with the judiciary to ensure the smooth functioning of the court system and address any future recommendations or requirements.
